North American Limited Warranty Statement

and Limitation of Liability

Ultrasave Lighting Ltd. (Ultrasave) warrants that, ballast products furnished by Ultrasave, except otherwise stated, with manufacturing date code after January 1996 will be free from defects in material and workmanship from the date of manufacture for the following time periods:

Two (2) Years:

     HID Magnetic

Three (3) Years:

CFL Electronic (UR-HT Series, case temp. between 76 deg C and 90 deg C)

HID Electronic (case temp. 90 deg or less)

     Magnetic Fluorescent

     LED Drivers

Five (5) Years:

All other Electronic Fluorescent (5 years or 25,000 hours, whichever comes first)

The warranty and remedies set forth herein are conditional upon proper storage and installation in conformance with current editions of National and local codes, Underwriters' Laboratories Inc., Canadian Standards Association standards for safety and any recommendations of Ultrasave. The conditions of tests concerning any ballast which is claimed to have not performed satisfactorily under this warranty shall be mutually agreed upon in writing and Ultrasave shall be notified of, and may be represented at all tests that may be made on the subject ballast.

If any ballast fails to meet the above warranty, and if the purchaser notifies Ultrasave in writing within thirty (30) days of discovery of the defect, and makes the ballast available, Ultrasave shall thereupon correct such defect, at Ultrasave's option, by either: (A) replacing the defective ballast (F.O.B. Ultrasave's plant, Office or other point of shipment) with an identical or similar product or (B) repairing the defective ballast if possible. Purchaser shall provide written notification of a claimed defect to Ultrasave and shall return the defective ballast to Ultrasave upon written instructions to do so. All leads on the ballast being returned must be at least 4 inches in length.

The foregoing shall constitute the sole compensation to the purchaser and the sole liability of Ultrasave with regard to warranty and Ultrasave makes no other warranty, statutory or otherwise, and none is implied. In particular, without limiting to foregoing, no warrant of salability or fitness for a particular purpose is made or implied.

Ultrasave's liability on any claim of any kind, including negligence for any damage arising out of, connected with, or resulting from this warrant, or from the supply or failure to supply a ballast, or from the design, manufacture, sale, delivery, resale, installation, inspection, repair, operation or use of a ballast furnished by Ultrasave, shall in no case exceed the purchase price allocated to the ballast or ballasts which give rise to the claim.

In no event, whether as a result of breach of contract, warranty, negligence or otherwise, shall Ultrasave be liable for special or consequential loss of use of ballasts or any other goods or equipment, cost of capital, cost of substitution equipment, downtime cost, or claims of customers or purchaser from such damage.

Note: Operation of Ultrasave High Intensity Discharge (HID) ballasts in frequently-switched applications or in conjunction with automated controls (such as, but not limited to, occupancy sensors) will void this warranty. Daylight sensors, for outdoor use, which operate the ballast once per day, are an exception.

It is recommended that operation of Ultrasave Instant, Rapid or Programmed Rapid Start ballasts with occupancy sensor or similar controllers should limit the cycle time to be greater than 10 minutes.  This will help minimize the switching cycles imposed on the lighting system.  It is a known fact that a motion sensor used in conjunction with Instant Start ballasts will shorten lamp life. Please be aware of this when choosing your desired lighting system.  Please contact the lamp manufacturer to determine what the warranty is for lamps used on this type of lighting system.
